Hotel Regulations and Booking Conditions

1. General provisions
These Terms and Conditions have been drawn up by Dobry Hotel Spółka z ograniczoną odpowiedzialnością sp.k., 7 Falista Street, 81-331 Gdynia, NIP: 5851455878 (hereinafter referred to as: ‘Service Provider’), specifying the rules for the operation of the hotel and the provision of hotel services, the rules for making reservations for hotel accommodation and the rules for the provision of services electronically through the website operated at www.hotelaqua.pl. The Service Provider is the operator of the hotel.
The Guest and the Service Provider are obliged to comply with the provisions of these Terms and Conditions from the moment the Guest starts using the Services provided by the Service Provider. The performance of the Services and the Guest's stay in the hotel shall take place in accordance with the Terms and Conditions.
2. Definitions
Guest - a natural person with full legal capacity or a legal person who uses the Services provided by the Service Provider in accordance with the provisions of these Regulations,
Services - each of the services provided in accordance with these Regulations, including in particular hotel services provided within the hotel and services provided electronically on the Website,
Website - a website that allows booking a hotel room on-line, using the Reservation System.
3. Type and scope of offered and provided Services
The Service Provider provides hotel services in accordance with the Act of 29 August 1997 on tourism services, the services include in particular:
hotel room rental,
catering services,
The possibility to book a hotel reservation is available:
  • via the Reservation System - an interactive form made available by third parties through the website, which enables the booking of a hotel reservation in a hotel available in the System,
  • via telephone using the Provider's telephone number available on the website,
  • via e-mail using the Provider's e-mail address available on the website,
  • personally - at the hotel reception desk.
Payments - the service provides the Guest with the possibility of making the payment for booking a hotel room online through cooperation with the tPay service. In the case of making a reservation in a different way than through the Reservation System, payment is also possible in cash, by bank transfer or by credit and debit cards.
The service provider accepts the following payment cards:
  • when paying On-Line: VISA, VISA Electron, MasterCard, Maestro, MasterCard Electronic, American Express,
  • when paying directly at the hotel: VISA, VISA Electron, MasterCard, Maestro, MasterCard Electronic, American Express.
In the operation of the hotel, hotel services are provided in accordance with the assigned category and standard of the hotel. In the event of any reservations concerning the quality of the services provided, the Guest is requested to report them at the hotel reception during his/her stay, which will enable the Service Provider to respond immediately.
As part of the operation of the hotel, the Service Provider provides in particular:
the Guest's stay at the hotel, including respect for the Guest's personal data in accordance with Article 6(1)(b) of the RODO (understood as Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC), i.e. the processing is necessary for the performance of the contract to which you are a party;
professional and courteous service with regard to all services provided at the hotel;
cleaning of the room (between 9:00 a.m. and 3:30 p.m.) and rectification of defects during the Guest's absence and only when the Guest requests it. 9:00 a.m. - 3:30 p.m.) and rectification of faults during the Guest's absence, and during the Guest's presence only if he/she wishes to do so;
technically efficient service; in the event of faults that cannot be rectified, the hotel will endeavour to alleviate the inconvenience caused as far as possible; in the event of damage repair. The Guest waives all claims and rights to compensation.
In addition, at the request of the Guest, within the scope of the hotel's operation, the Service Provider provides, among others, the following additional services:
  • provision of information related to the stay and travel;
  • wake-up call at a specified time;
  • storage of valuables in a safe during the Guest's stay in the hotel, in accordance with the relevant provisions of the Civil Code;
  • storage of luggage (the hotel may refuse to accept luggage for storage on dates other than the dates of the Guest's stay and refuse to accept for storage items that do not have the characteristics of personal luggage);
    ordering of transport service;
    paid room-service.
    4. Hotel regulations
    The room in the hotel is rented for the day. A hotel day starts at 3 PM on the day of arrival and ends at 11:00 AM on the day of departure.
    If a Guest, when renting a room, does not specify the duration of his/her stay, one day of room rental is assumed.
    At the Guest's request and to the extent possible, the Hotel may extend the hotel day for an additional charge.
    The Guest should notify the reception desk of his/her wish to extend the stay or extend the hotel day by 10:00 a.m. on the day of the original departure. The Hotel will take into account the wish to extend the stay as far as possible.
    In a situation when the Guest does not leave the room after the end of the hotel day, the Service Provider reserves the right to have the Guest's belongings packed by a commission by at least two representatives of the hotel, one of whom must be the Director or the Hotel Manager. Items packed in this way will be deposited at the hotel and will be available for collection at reception.
    Items left in the hotel room after the Guest's departure will be sent back to the address indicated by the Guest - at the Guest's expense. In the absence of such an instruction, the hotel will keep the left items for a period of 3 months.
    A request to shorten the stay must be made by the Guest at the hotel reception no later than 18:00 on the day before the planned shortening of the stay. Otherwise, the next hotel day shall be deemed to have begun, unless the terms and conditions of the offer purchased by the Guest state otherwise.
    The Guest may not transfer the room to other persons without prior registration of the third party at the reception, even if the period for which he or she has paid the fee for the stay has not elapsed.
    Persons who are not checked in to the hotel may stay in the hotel room after prior notification to the hotel reception, only between 6:00 a.m. and 10:00 p.m.
    After checking in to the hotel, the Guest should familiarise himself with the equipment of the room and keep it intact; in case of noticing any damage, the Guest should immediately notify the hotel reception. If the Guest fails to inform and the hotel staff finds the damage, the Guest will be held financially responsible for the damage.
    The Guest shall be held responsible for damage to hotel property caused by himself, persons for whom he is responsible and his visitors.
    The Guest is obliged to pay the cost of his/her stay and any services and goods ordered or used, at the latest when checking out of the hotel. In the event of non-payment of all dues related to the stay, the Service Provider shall be entitled to charge the Guest for any services and goods provided to the Guest.
    The Hotel is liable for loss of or damage to items brought in by the Guest within the scope of the relevant provisions of the Civil Code.
    Valuables, money and documents should be stored in a locked safe located in the room or in a deposit box at the reception.
    If valuables are left outside the safe, the Hotel is not responsible for them.
    The Hotel observes curfew from 10:00 p.m. to 6:00 a.m.
    The behaviour of Guests and persons using the Hotel's services should not disturb the peaceful stay of other Guests. The hotel may refuse to provide further services to a person who violates this rule. Smoking is prohibited in the hotel. In the event of violation of the prohibition, the Hotel Guest may be charged a contractual penalty in the amount of PLN 1,000 for each stated violation of the prohibition and is also obliged to cover the costs of an unjustified call to the services automatically notified by the fire protection system.
    Each time the Guest leaves the hotel room, the Guest is obliged to properly secure it so that access by third parties is not possible. During the Guest's absence from the room, windows and doors must remain closed.
    In the event of spotting a fire, the hotel staff must be notified of the danger as far as possible and you must head for the exit in accordance with the instructions indicating the direction of evacuation. Until the arrival of the fire brigade, it is the responsibility of the hotel staff to evacuate the occupants.
    For fire safety reasons, it is forbidden to use appliances that are not part of the room equipment (e.g. heater, electric cooker, etc.) in the hotel rooms.
    The hotel has the possibility to charge a local tax in the amount according to the applicable regulations.
    5. Reservation of a hotel room
    Reservation of a hotel room is available:
    • through the Reservation System,
    • by phone,
    • by e-mail,
    • in person at the reception of the hotel.
    In order to make a reservation, it is necessary to accept the Terms of Service, provide personal data necessary to render the services (such as: name and surname, address, date of stay, method of payment) and pay partially or fully for the stay - depending on the regulations of a given offer or individual arrangements. If the regulations of a given offer do not require payment in any part of the costs of the stay before the start of the stay, the Service Provider does not guarantee the Guest to book a hotel place. The Guest is entitled to provide only complete and correct data. The Guest acknowledges and accepts that it is prohibited to provide unlawful content to the Service and the Service Provider.
    In the case of making a booking via the Reservation System, in addition to the conditions indicated in paragraph 2, it is necessary to confirm the booking by pressing the ‘I book and pay’ button and to make payment via the eCard system or during the stay at the hotel, if such a method is available.
    At the time of booking, the Service Provider informs about:
    the main data concerning the booking, consistent with the content of the data provided by the Guest and the price of the services,
    the data identifying the Service Provider,
    the lack of the right to withdraw by the Guest who is a consumer within the meaning of Article 22[1] of the Civil Code from the agreement on the provision of hotel services pursuant to Article 38(12) of the Act of 30 May 2014 on consumer rights,
    the need for additional payment for services not included in the booking, in the event that the Guest orders additional services during his/her stay at the hotel.
    Once a booking has been made via the Reservation System or by email, the Service Provider will send the Guest a confirmation of the booking along with the information referred to in paragraph 4 above to the email address indicated by the Guest. In the case of a booking made by phone or in person, the information referred to in paragraph 4 above will be provided to the Guest during the booking or in any other manner agreed with the Guest.
    6. Cancellation of reservation of accommodation
    The cancellation of the reservation made by the Guest shall be done in the same way in which it was made.
    Resignation from the reservation of a room is possible one day before the declared date of commencement of the booked stay at the latest, unless the terms of the given offer state otherwise.
    The booking fee is the charge for the first unused hotel day of all rooms booked by the Guest, unless the terms of the respective offer state otherwise. In the case of a booking made under non-refundable offers (for example HOT DEAL), the booking fee is the amount due for all unused hotel nights of all rooms booked by the Guest.
    In the event of a correctly made cancellation, the Service Provider shall immediately, but no later than within 14 days of the cancellation, refund the payment made by the Guest minus the booking fee if this was provided for in the terms and conditions of the offer on the basis of which the booking was made.
    7. Liability of the Service Provider
    The Service Provider is not liable for non-performance or improper performance of its obligations under the Regulations caused by circumstances beyond the Service Provider's control despite exercising due diligence.
    The Service Provider shall also not be liable for damages resulting from the suspension or discontinuation of the Services by the Service Provider.
    In addition, the Service Provider shall not be liable for damages, including lost profits, incurred as a result of Guests using the Services in a manner contrary to the Terms and Conditions or the law.
    The limitations of liability do not apply to a Guest who is a consumer within the meaning of Article 22[1] of the Civil Code.
    8. Intellectual property of the Service Provider
    Information resources and all other contents of the service, such as texts, graphics, logos, buttons, images are the intellectual property of the Service Provider or entities with which the Service Provider has entered into appropriate agreements and are protected by Polish and international regulations concerning the protection of intellectual property, in particular by the provisions of the Act of 4 February 1994 on copyright and related rights.
    It is forbidden, without the consent of the Service Provider, to copy, reproduce or any other use in whole or in fragments of information, data or other content available on or from the website, except for cases of permitted use resulting from generally applicable laws.
    9. Complaints
    The Guest has the right to lodge a complaint relating to the functioning of the website and the performance of the Services by the Provider not in accordance with the terms and conditions specified in the Regulations.
    All complaints, including the Guest's details, i.e. name and surname, together with e-mail address and a concise description of the reported objections, should be submitted via the contact address available on the main page of the website in the ‘Contact’ tab or in writing to the Service Provider's address.
    The Service Provider shall consider the complaint within 14 days from the date of its receipt.
    If the complaint relates to the electronically provided services and cannot be resolved within 14 days, the Service Provider will notify the Guest of the reasons for the delay and the expected timeframe for resolving the complaint.
    10. Final provisions
    The content of the Terms and Conditions is subject to change. The Guest will be informed of any changes through a notice on the Service Provider's website. The effective date of the changes will not be less than 14 days from the date of their announcement.
    The settlement of any disputes arising between the Service Provider and the Guest, who is not a consumer within the meaning of Article 22[1] of the Civil Code, shall be submitted to the court having jurisdiction over the seat of the Service Provider.
